Supreme Court Leaves $25 Million Decision in Place
In the 2019 case in question, California resident Edwin Hardeman sued Bayer, claiming that after using Roundup for more than 30 years to control weeds at his home, the product caused his non-Hodgkin’s lymphoma. The original ruling, in which the jury awarded Hardeman $80 million in damages before the judge reduced the amount to $25 million, was upheld by the U.S. 9th Circuit Court of Appeals.
In its ruling, they stated that Hardeman’s legal team had proved that Roundup was defectively designed. They also noted the lack of a cancer warning label and manufacturer’s negligence in continuing to produce, market, and sell the product. The Supreme Court also stated that the company had demonstrated “reckless disregard” for victims’ health and safety.

What makes this verdict even worse for Bayer is the fact that legal experts consider it a “test case” for thousands of similar lawsuits. Supreme Court Asks EPA to Reassess Roundup Cancer Risk
The same court that upheld the Hardeman verdict has also asked the Environmental Protection Agency to review evidence on whether or not glyphosate, the active ingredient in Roundup weed killer, presents legitimate risks to humans and the environment.
Although in 2020, the EPA determined that glyphosate doesn’t pose a serious cancer risk, the appeals court disagreed, saying the EPA needed to more thoroughly consider the research. Bayer continues to argue that the Roundup cancer claims are not in agreement with the EPA’s statements, despite the fact that cases continue to pour in from victims who have been harmed by the product.
This verdict will be on its way in October 2022.
