In 2018, Bayer acquired the Monsanto company, and since then they have faced a consistent onslaught of Roundup cancer lawsuits. After a flurry of losses in court over the past few years, in late July Bayer set aside an additional $4.5 billion (on top of $11.6 billion they had already reserved) to help them pay victims. Recently, however, Bayer won its first lawsuit against plaintiffs, which has many wondering what this means for victims. I’ll explain below, and if you decide that you need a New York Roundup lawsuit lawyer, don’t hesitate to contact Buttafuoco & Associates for help.
Roundup Lawsuit Background
As the most widely used herbicide in the world, Roundup was initially seen as a godsend for farmers and gardeners alike. However, in 2003, serious questions began to arise about the product’s safety when studies showed that exposure to glyphosate (the active ingredient in Roundup) resulted in above-average rates of non-Hodgkin’s lymphoma. Farmers in particular were disproportionately afflicted by the disease, as they were exposed to extremely high levels of dangerous chemicals. By 2015, the World Health Organization had categorized glyphosate as a “probable human carcinogen,” meaning that it causes cancer.
Over the years, Roundup has also been connected to Leukemia and B-cell lymphoma. In just a few years, thousands of lawsuits have been filed, alleging that Roundup use caused plaintiffs’ cancer. Despite many losses in court and mounting evidence the product is life-threatening, Bayer continues to claim Roundup is safe for use.

What does Bayer’s Recent Win in Court Mean for Roundup Cases?
In late October, Bayer won its first Roundup case in California state court. The plaintiff’s lawyers argued a child’s non-Hodgkin’s lymphoma was caused because his mother was exposed to Roundup while using it in her garden. Ultimately, the jury determined the child’s cancer was not caused by Roundup exposure. Of the four trials that have occurred in California courts, this was the first one the company won.
Although the verdict may be worrisome to those who are considering filing a Roundup lawsuit, settlement amounts for remaining cases will not be affected. This case was far more difficult to prove than others, as lawyers argued that the child’s cancer was caused not by his own exposure, but his mother’s. This verdict is no reason to avoid filing a Roundup cancer lawsuit if you believe your cancer has been caused by this toxic product.
A verdict in another recent case, that of Donnetta Stephens (who claims her non-Hodgkin’s lymphoma was caused by Roundup use), is expected soon. Meanwhile, lawsuits continue to be filed.
