The honest answer is that not every injury needs a lawyer. A fender bender with a sore neck that resolves in a week does not require representation, and any firm telling you otherwise is not being straight with you.
But a large number of people who should have called an attorney did not, and by the time they realized it, the evidence was gone or the deadline had passed. The purpose of this page is to help you tell which situation you are in.
When You Probably Do Not Need a Lawyer
If your injuries fully resolved within days, you missed little or no work, fault is undisputed, and the insurer has offered to cover your medical bills and property damage, handling it yourself is reasonable.
Even then, do not sign a release until you are certain you have recovered. A release ends your claim permanently, including for symptoms that surface later.
When You Should Call Immediately
You were seriously hurt. Any injury requiring surgery, hospitalization, or ongoing treatment.
Fault is disputed or shared. This is now urgent in New York motor vehicle cases. A 2026 amendment bars recovery entirely when the injured person’s fault exceeds the other side’s, as our comparative fault guide explains. Fault percentage used to trim a settlement. A government entity may be responsible. A city bus, a municipal vehicle, a public sidewalk, a school, a public hospital. A notice of claim is generally due within 90 days. See statute of limitations.
You were hurt on a construction site. Labor Law claims against owners and general contractors exist alongside workers’ compensation, and workers routinely do not know they have them.
A commercial vehicle was involved. Trucking companies dispatch investigators immediately. Electronic logs and driver files are subject to retention schedules that expire.
The insurer wants a recorded statement. That request is a signal to get advice first.
You suspect medical malpractice. These claims carry a shorter deadline and require medical review before filing.
Someone died. Wrongful death claims run through the estate and require appointment of a representative before anything else happens.
Why Timing Matters More Than People Realize
The strength of a case is largely determined in the first few weeks, before most people are thinking about lawyers at all.
Surveillance footage from stores, garages, and buildings is routinely overwritten within 7 to 30 days. Vehicles get repaired or scrapped with the event data recorder still inside. Skid marks wash away. Witnesses move and stop answering. A preservation demand sent in week one saves evidence that no amount of effort recovers in month six. Medical timing matters equally. A gap between the accident and first treatment is the most common argument insurers use to claim you were not really hurt.

Investigation begins immediately. Preservation letters, scene documentation, witness statements while memories are fresh.
